Mr Jim Kenyon – Chair Independent Hemsworth Town Council has just responded to a Parishioners question about the legal fees which YOU have to pay for the Solicitors / Barristers for Independent Hemsworth Town Council to defend the Court Case against Saul Construction Limited.
£148,000.
ONE HUNDERED AND FORTY EIGHT THOUSAND POUNDS
If, as expected Independent Hemsworth Town Council lose the case they will more than likely also have to pay Saul Construction Limited’s legal fees too.
Ferret posted yesterday about mediation which is to take place between both parties in December 2021.
Mediation is not a sign of weakness on either party in any legal case.
It is an expectation, under section 10 of the PRE-ACTION CONDUCT AND PROTOCOLS
10. Parties may negotiate to settle a dispute or may use a form of ADR including—
(a) mediation, a third party facilitating a resolution;
(b) arbitration, a third party deciding the dispute;
(c) early neutral evaluation, a third party giving an informed opinion on the dispute; and
(d) Ombudsmen schemes.

This is Independent Hemsworth Town Councils opportunity to complete on the contract which was previously agreed.

According to the bodger mediation is capitulation of the other party methinks he is like other Badgers known as they are to have bad eyesight and he can’t see or does not want to see what’s coming.
Ferret would have to agree.
Bodger Kenyon does not want anything taking place that will risk more exposure of his continued lying, from simple questions about his “qualifications” to the forensic Frenkel report that backfired in his face and found nothing wrong and this includes mediation. He is still even refusing to release that in full so we must assume the redacted part that HTC said referred to Saul must also be regarded with suspicion. Councillors must know the full truth and there is no legal reason that it should be withheld especially from councillors and whoever is taking part in the mediation process meeting. Imagine the embarrassment of being armed with bodgers lies up against people with real qualifications. If it wasn’t for the enormous cost it would be laughable.
Wasn’t it £105,000 pounds not long ago, now admits to £148,000 . Another lie found out from Kenyons mouth. I expect this will be much greater when the real truth finally emerges.
Only a matter of time before that self preservation kicks in here and the first rat desert the HTC sinking ship and it’s like a scene from Scarface with Jim playing Al Pacino part. But as it’s been said, it’s not funny because he is using Hemsworth parishioner’s money to fund his pipe dreams and stoke his over inflated ego.
Has the mediation meeting between Saul and HTC taken place? Or do we know if HTC are still defending this reckless persuit.
I hope the new councillor is involved in this meeting.
