Mr James (Jim) Kenyon and Mr Ian Womersley (Independent) have repeatedly gone on record stating the “Sports Complex belongs to Hemsworth Town Council and it will not be sold to Saul Construction Limited”.

The date for the trial has been set for March 21st to 24th 2022.

Ferret has taken some time to look at the financial aspects of the disclosures in yesterday’s post.

The estimated legal costs are circa:

• Hemsworth Town Council £200,000

• Saul Construction Limited £150,000

The losing side in cases such as this usually have to pay the costs of their opponent.

So, either party are looking at having to pay £350,000 in costs whatever the outcome.

There are two possible outcomes to the case:

1. Hemsworth Town Council retain the former Sports Complex site on Kirkby Road in Hemsworth.

If this were to happened Hemsworth Town Council could be forced to pay restitution costs of £2.75m + £50,000 advance payment of the Sports Development Contribution.

£2.8 MILLION POUNDS to retain the former Sports Complex site.

Or

2. Hemsworth Town Council are forced to complete the sale of the former Sports Complex site on Kirkby Road in Hemsworth to Saul Construction.

If this were to happened Hemsworth Town Council could be forced to pay Saul Construction Limited’s costs of £350,000.

SO

If Hemsworth Town Council “WIN” the case they could retain the Sports Complex Land and owe Saul Construction Limited £2.8 MILLION POUNDS.

Or

If Hemsworth Town Council “Lose” the case they could lose the Sports Complex land and owe Saul Construction Limited £350,000.
