Data protection warning issued to homeowners who use CCTV

Ferret has been made aware of the recent court case of Fairhurst v Woodard.

It saw the claimant bring action against the defendant who had installed a camera on their shed, linked with a doorbell system.

Ruling in favour of the claimant, the judge said: “Personal data may have been captured from people who are not even aware that the device is there-or that it records and processes audio and personal data.”

As reported previously by Ferret, every homeowner, including Jean Eccles, should be mindful of their security cameras capturing footage of public areas and shared spaces.

Settings should be adjusted accordingly so they don’t intrude on neighbouring properties and are not looking out on public spaces. Audio settings should also be adjusted to ensure privacy among neighbours and passers-by.

The judge’s decision has made the position very clear.

If you are using CCTV, then you must take into account and respect the privacy of others.

It is totally unacceptable that people who are simply wanting to use their own park have their privacy invaded, especially by the chair of the Town Council, who has supposedly been elected to represent them and abide by values enshrined in law.

Our community’s access to the park has been restricted by the appropriately named Ecclesgate and its removal is long overdue.

Ferret has to wonder why Mystic Jean, the queen of the crystal ball, would need to resort to such modern methods to find the answers to any questions that may be perplexing her in the first place?

Surely she should have foreseen this coming?
